Receiving a diagnosis of cancer leaves anyone with no ground and not knowing where to go. At this time, the support of family and friends is essential. What most people do not know is that there are some rights that are guaranteed by the government to the person with cancer.

Those mentioned above are benefits related to the time of service provided by the Unified Health System (SUS), high-cost drugs, breast reconstruction, and social security aspects. Start of treatment within 60 days

After the diagnosis signed by the doctor, the cancer patient is entitled to start treatment within 60 days by the SUS – or in a shorter period, according to the therapeutic need. It is considered as the beginning of treatment the surgery or the radio or chemotherapy sessions, according to the medical indication.

Those who do not get the care within this period should seek the municipal Health Department. If you do not get a return, you can go to the judicial system, through the Office of the Public Defender, the Public Prosecutor's Office or a private lawyer.

 

Access to high-cost drugs

The cancer treatment is expensive. Therefore, one of the rights of people with cancer is access to high-cost drugs. For this, the patient should attend health posts, secretaries or hospitals, with personal documents, proof of residence, as well as medical and prescription report, with the full description of the medicine.

 

Out-of-home care

When the patient's city of residence does not offer the diagnostic and therapeutic resources for the treatment of the disease, he has the right to be treated in another municipality, even if it is in another state. It is a guarantee of comprehensive health care offered by SUS.

 

Withdrawal from Workers Severance Guarantee Fund (FGTS) and Social Integration Program (PIS)

Malignant tumors and their dependents are entitled to withdraw from the FGTS and the PIS. To do this, they must present personal documents, citizen's card, work permit, and a medical certificate obtained no more than 30 days. For dependents, a document proving kinship with the patient is also required.

 

Sickness aid

Patients with cancer enrolled in the National Social Security Institute (INSS) who had to leave for more than 15 days of work and are unable to exercise their professional activity temporarily can receive the sickness benefit. For serious diseases, there is no lack of benefit. To apply, you must submit a medical report.

 

Breast Reconstruction

Women who have had to remove their breast, partially or totally, during the treatment of cancer have the right to perform breast reconstruction surgery by SUS. This right is very important for the psychological well-being of patients, because it brings hope and elevates self-esteem.
